Available Damages in New Jersey Personal Injury Cases

Economic Damages

Punitive Damages

Unlike compensatory damages, punitive damages are not designed to compensate the victim. Instead, they are intended to punish the wrongdoer and deter similar conduct in the future. Punitive damages are not typically awarded in personal injury cases because they are reserved for the most egregious cases. If a judge or jury awards punitive damages, there must be clear and convincing evidence of malice or extreme recklessness. Punitive damages are capped at $350,000 or five times the amount of compensatory damages, whichever is greater, under New Jersey law. Damage caps do not apply in cases where the defendant is convicted of a crime related to the injuries.
