Mandatory Auto Insurance Coverage in New Jersey

New Jersey’s car insurance laws are more complicated than those of many other states. First, the state operates under a no-fault insurance system, so drivers turn to their own car insurance for coverage of medical expenses and lost wages first, even if someone else was responsible for the crash.

Next, the state offers a “basic” policy that limits the amount of insurance that drivers must maintain, which only provides for property damage liability coverage of $5,000 and no bodily injury liability coverage. Standard policies include bodily injury liability insurance of a minimum of $25,000 per person, $50,000 per accident, up to $250,000 per person, $500,000 per accident for an extra cost.

Those with standard policies select whether they want a limited right to sue or an unlimited right to sue if someone else is found at fault for the accident. A limited right to sue only allows car accident victims to sue the at-fault driver if they suffered a significant injury, such as a displaced bone fracture, the loss of a body part, a permanent injury, permanent scarring or disfigurement, or the loss of a fetus. With an unlimited right to sue, there is no applicable injury threshold.

All drivers must maintain Personal Injury Protection (PIP) insurance coverage, which helps pay for their medical expenses and lost wages regardless of fault.
